Suspected Door Kick-in Burglars Released on $15,000 Bail

Police said the duo stole more than $22,000 in firearms, jewelry and electronics.

 

 

The day after two suspected burglars were arrested and accused of of stealing more than $22,000 in firearms, jewelry and electronics from at least four Howard County residences, they were released on $15,000 bail, court officials said this week. 

Howard County prosecutors said they tried to increase the bond, but without success.

“I don’t believe $15,000 would be the first number that came to mind,” said Natasha M. Byus, the Howard County assistant state’s attorney handling the case. “I did not have an opportunity to speak with the commissioner before the bond was set.”

Both Joseph Leo Baumgarten, 40, and Dianna Lynn Marketti, 30, posted the full bail on Oct. 5 after being charged with 25 counts each, including first-, second- and fourth-degree burglary, breaking and entering and destruction of property for their alleged involvement in burglaries in Columbia, Ellicott City and Woodbine.

Police said the duo is suspected in 10 more burglaries that they haven’t yet been charged in, but followed a similar style— the suspects would kick-in a door, find their way to the master bedroom, ransack it and steal valuables.

In late September, police issued a statement asking residents to be vigilant after 10 burglaries matching this style occurred in one week.

According to Byus, the District Court Commissioner set the bail before the state’s attorney’s office could make a recommendation on the suspects’ bail.

Byus filed a motion shortly after the suspects were released on bail asking that the court set a bond of $600,000 for Baumgarten and $300,000 for Marketti.

In Byus’s motion, she noted that Baumgarten, of Pasadena, had violated his probation five times previously after being convicted of burglary for three offenses from 1996, one from 2002 and another from 2008. She also noted that Baumgarten had failed to appear in court for traffic offenses on five occasions.

Marketti, who is listed at an address in Dundalk in court records, currently has 15 active traffic cases, most of which are for driving on a suspended license, with one as recent as Sept. 26.

In the court documents pertaining to this case, it was noted that in the four burglaries currently charged to Baumgarten and Marketti, police said they allegedly stole more than $10,000 worth of jewelry and six firearms, including a .40 caliber Beretta Cougar and a Taurus .38 special, among other items.

Howard County police, who tracked down the suspects through Baltimore Ravens tickets and combing local pawn shops, declined to comment on the suspects' release.

Byus said she has asked the court to place a hearing on the calendar as soon as possible to adjust the suspects’ bail in the case.

“I am hoping that a Circuit Court judge would consider the motion and provide an appropriate bond that would require their presence in upcoming hearings, and, more importantly, ensure the safety of Howard County residents,” said Byus.

We wonder why we have repeat offenders like this?! The bail set is a joke. Now they have time to rob some more so they will have money if their bail amount is raised. Our justice system failed us on this one!

Who is the district court commissioner? Is this an elected office or appointed? What does he/she want to do, invite the burglars to have a field day in Howard County? The male burglar had violated parole already...what does it take to have a legal system sympathetic to the victim rather than the criminal?

District Court Commissioner is responsible for setting bail and signing release papers. I'll call their office on Monday morning and find out who set the bail.

The problem is the Assistant States Attorney Natasha M. Byus who didn't talk to the commisioner before the bail hearing and now she is back pedaling to try to get another bail hearing set after the fact. I hope they go to her home while see is letting other criminals go free.

...by the way, I think finding out what happened regarding the low bail, and then following up your concern is the way to go, not to invite more unhealthy behavior. I empathize with your feelings, my home was broken in to, while two of my adult sons were home...suffice it to say, I am glad that my oldest did not catch the dude. I dealt with the perpetrator thru the court process. I believe this was more effective than my son, chasing after the guy, who could have had a number of buddies ready to take my son out....think about it. Violence, etc, doesn't have to beget violence....

I'm sorry that you were victim to a break in. One of my neighbors was also victim to a break-in. I'm not not civil and would rather they get what they deserve at the hands of someone else b/c the justice system is too easy to get around as we can see what happened with these 2. I thought the hearing was originally set for the 30th and I was going to try to make it. How did they get out in 2 days?

Yes, I agree, it is a serious problem. But, I believe our entire justice system is failing, not just in HC. I applaud you for considering attending the hearing, but, since that did not happen, we have other pro active responses, other than continuing the violence , etc,

These folks clearly have no respect or regard for the law. This was not a first time offense. Prior sentencing has done nothing to deter behavior. I just do not understand how they can be allowed to be released for such a small amount.

It looks like the Commissioner is appointed by whoever is the County Administrative Judge, in this case, LENORE ROSALIE GELFMAN, County Administrative Judge, Howard County Circuit Court, 5th Judicial Circuit, since November 5, 2011:

Looks like plenty of blame to go around here, but as usual, nobody is stepping up to take responsibility. Where is the County Exec. Ulman on all this? Why doesn't Patch call his office on Monday and ask for/demand comment? You are journalists, right?

Thanks Cola MD ! Each one of us can make phone calls to whichever one of these individuals we care to. You do not have to be a reporter to contact your county exec, or your county Admin Judge, etc. I think we should all contact all of them, write a letter to the Col. Flyer, the Balt. Sun etc. I rec'd a call from FOX News DC who is interested in following up on the story. Let go folks, speak up. Hopefully without the threats etc. Be honest, be passionate, be thoughtful...contact! I am going to do my part. I will keep you posted with, my success or failure getting through! Please post the email address's and I will be glad to share my viewpoint with them. You dont need a college degree to simply look at their past and see that letting them out with $15k bail is a problem. Once again, HoCo is one of 5 counties in the entire US that outlaw non-lethal means of protecting ourselves. I can buy a pump shotgun and take one of these goofs out. Or I can get a taser. Thanks HoCo and Friends for your myopic talents as usual.

My opinion is, w/o that direct info, we should all contact the County Exec. Ken Ulman, if he doesn't know, or if he doesn't care, the proof will be in the puddin. That is my personal belief. If everyone who has posted their concern, contacts Ken Ulman's office, by

Ken Ulman is the LAST person I would vote for on anything. He is a complete sell out and has squandered the trust of all those that believed he was not going to over-develop the county. I am deeply disappointed in HoCo and what it has become thanks to him and his buddies.

AML, thank you. I do believe this needs to be addressed. Since we are not getting any info from the folks that have been deemed responsible, the County Executive, Ken Ulman, should see our concern and address this. I have been very disappointed in the response, excuse me, lack of response from those responsible. I am an optimist, so I am hopeful that Mr. Ulman will address this terrible injustice to the victims of Howard County. If not....then we will have to go from there.

AML and all other posters, have you noticed this issue has just disappeared? Right in front of us, and despite this thread and contacting Ulman. Something has been very squashed. I would like to reopen this wound, together. Any takers? Please realize that is exactly what they hope we will do. It is NOT too late. We gave those in positions of authority to respond and they have dismissed us. Is that what we want? Not me, but I know the power of a communal voice. This was/is SO wrong.

If these 2 are suspect in other break-ins why won't they post their mug shots for all to see? This doesn't make sense to me but then again this whole thing doesn't either
